This Service Agreement ("Agreement") is made effective as of [Date], by and between Kuttysoft Infotech Private Limited ("Service Provider"), with its principal place of business located at No.23-74, Antony Street, Rajakrishnapuram, Rajakrishnapuram Post, Tirunelveli, Tamil Nadu, India, 627114, and the Client ("Client"), collectively referred to as the "Parties."
The Service Provider will offer web development, designing, app development, web hosting, server maintenance, game development, reselling of web hosting, domain names, SSL certificates, and other related services as described on the Service Provider's website (https://www.kuttysoft.com).
Fees for services will be as per the Service Provider's standard pricing or as agreed upon in writing. Payment methods accepted will include [list all accepted payment methods], compliant with the requirements of major payment gateways and platforms like Google.
The Service Provider agrees to comply with all applicable laws, regulations, and guidelines, including but not limited to data protection laws, copyright and intellectual property rights, and industry standards. The Service Provider will also ensure compatibility and compliance with major websites and payment gateway providers.
Both parties agree to maintain the confidentiality of proprietary information and not disclose such information without the other party's written consent.
The Service Provider's liability shall be limited to the amount paid by the Client for the services rendered. In no event shall the Service Provider be liable for any indirect, special, or consequential damages.
All works created in the course of the services provided shall remain the intellectual property of the Service Provider unless otherwise agreed in writing. The Client is granted a non-exclusive license to use the products of the services for their business operations.
This Agreement may be terminated by either party with written notice. Upon termination, the Client shall pay for all services rendered up until the termination date.
Any disputes arising under this Agreement shall be resolved through arbitration in accordance with the laws of Tamil Nadu, India.
No amendment to this Agreement shall be effective unless in writing and signed by both parties.
This Agreement shall be governed by and construed in accordance with the laws of the State of Tamil Nadu, India.
